General Terms and Conditions

Article 1 – Definitions
In these General Terms and Conditions (GTC), the following terms shall apply:

  • Right of withdrawal : The consumer's right to withdraw from a distance selling contract within a certain period.

  • Consumer : A natural person who, when concluding a distance contract, is not acting in the course of their commercial or self-employed professional activity. The consumer is one of the contracting parties and enjoys statutory consumer protection.

  • Day : A period of 24 calendar hours.

  • Contract duration : A distance selling contract for the purchase or delivery of products and/or services over a specific period.

  • Durable medium : A means that enables the consumer to store personal data in such a way that it can be retrieved unchanged at a later time.

  • Entrepreneur : A natural or legal person who concludes distance contracts with consumers and offers them goods and/or services.

  • Distance selling contract : A contract concluded exclusively using means of distance communication, without the contracting parties being simultaneously present in the same place.

  • Distance communication means : Means that enable the conclusion of a contract without the physical presence of the consumer and the entrepreneur.

  • General Terms and Conditions : These General Terms and Conditions of the entrepreneur.

Article 2 – Scope
These terms and conditions apply to all offers, concluded distance contracts and distance orders between entrepreneurs and consumers.

Consumers are advised to familiarize themselves with the terms and conditions before concluding a distance selling contract. If this is not possible, they must be informed that the terms and conditions are available from the business and will be sent free of charge upon request.

If the terms and conditions are provided electronically, this must be done in a form that allows the consumer to easily store them on a durable medium.

Special conditions for certain goods or services apply in addition to these terms and conditions. In case of conflict, the regulation that is more favorable to the consumer shall prevail.

If any provision is invalid, the remaining provisions shall remain in effect. The invalid provision shall be replaced by a provision that most closely approximates the original purpose.

Article 3 – Offer
If an offer has a limited validity period or is subject to conditions, this must be clearly stated.

This offer is non-binding. The company reserves the right to change it.

The offer must contain a complete and accurate description of the goods/services. Images must correspond to the actual product. Obvious errors are not binding.

Prices do not include import duties and VAT, which are borne by the buyer.

The offer must contain the following information:

  • Procedure for concluding the contract

  • Validity period of the offer or price guarantee

  • Any costs of remote communication

  • Procedures for accessing and archiving the contract

  • Option to review and correct entered data before confirmation

  • Other languages available for the contract

  • Ethical standards of the entrepreneur

  • Available sizes, colors, materials

  • Shipping costs shown separately

Article 4 – Conclusion of Contract
The contract is concluded as soon as the consumer accepts the offer and fulfills the conditions.

If acceptance is made electronically, the business confirms it immediately. The consumer can reject the acceptance until this confirmation has been received.

The entrepreneur must take technical and organizational measures to secure electronic transactions.

The business owner is allowed to check the consumer's creditworthiness.

The consumer receives:

  • Address for complaints

  • Procedure for exercising the right of withdrawal

  • Information on warranty and customer service

  • Further legally required information

The contract is concluded subject to the availability of the goods. If the goods are not available, the seller may contact the customer up to three times; subsequently, the next available variant (size/color) will be sent.

Article 5 – Right of Withdrawal
The consumer has the right to withdraw from the contract within 30 days of receiving the goods without giving any reason.
During this period, careful handling of the product and packaging is required.

The cancellation must be made in writing or by email within 30 days, and the goods must be returned within 30 days.

Article 6 – Costs of Cancellation
In the event of cancellation, the consumer bears the return shipping costs.
Refunds will be issued within 14 days of receipt of the goods or presentation of proof of shipment.
Orders refused upon delivery without redelivery will not be refunded.

Article 7 – Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to:

  • Custom-made or personalized products

  • Personal Products

  • Goods that cannot be returned for hygienic reasons

  • Perishable goods

  • Newspapers and magazines

  • Audio/video recordings or software, if open

  • Services (accommodation, transport, meals, leisure activities on a specific date)

  • Services provided with the consumer's consent before the end of the withdrawal period

  • Betting and lotteries

Article 8 – Prices.
Prices remain unchanged during the offer period, except in the event of changes in the VAT rate.
Price changes due to fluctuations in the financial markets are possible.
Price adjustments within three months of the conclusion of the contract are only possible within the legally permissible framework.
Delivery is made from the country of dispatch. For deliveries outside the EU, the buyer bears customs duties and VAT.

Article 9 – Performance and Guarantee
The seller guarantees that the goods conform to the contract, offer, and legal requirements.
This guarantee does not affect the consumer's statutory rights.
Defects or incorrect deliveries must be reported in writing within 30 days and the goods must be returned in their original packaging.

The warranty is void if the consumer has made modifications or repairs, or if the defect was caused by government regulations.

Article 10 – Delivery and Execution
The entrepreneur processes orders carefully.
Orders must be executed within 30 days; otherwise, the consumer may cancel within 14 days and request a refund.
If delivery is not possible, a substitute product must be offered, with reference to the free return policy.
The entrepreneur is liable for the product until delivery to the consumer.

Article 11 – Contract duration: Termination and renewal

  • Termination : Consumers can terminate open-ended contracts at any time with a notice period of one month.

  • Fixed-term contracts : Terminable after expiry with a notice period of at least one month.

  • Renewal : Fixed-term contracts do not renew automatically, except for magazines, for a maximum of 3 months.

  • Contracts for 1 year : The consumer can terminate the contract at any time with one month's notice.

Article 12 – Payments
Unless otherwise agreed, payment must be made within 7 days of the start of the withdrawal period as defined in Article 6(1).
For service contracts, the payment period begins upon confirmation of the contract.
The consumer must check payment details immediately and report any errors.
In the event of non-payment, the trader may charge reasonable costs in accordance with the statutory provisions.

Article 13 – Complaints
Complaints regarding the performance of the contract must be submitted in detail within 7 days of discovery.
The trader must respond within 14 days. If processing takes longer, the trader will inform the consumer of the expected duration.
If the complaint is justified, the trader will replace or repair the product free of charge.
In case of a dispute, the matter will be referred to the competent authority.

Article 14 – Disputes
This contract is governed exclusively by Dutch law. This means that the interpretation, validity, and performance of the contract are governed by Dutch law, regardless of the consumer's place of residence.
